Legal Question in Personal Injury in Arizona
Tough one here and long. My girlfriend is or was represented by an attorney out of state regarding insurance money from her father being killed by a driver hitting him at high speed while he was sitting at a stoplight. This case is in its 2 year and being fought by her sister and the woman who was married to her father at the time and is near being settled to where she is getting a small amount of money compared to the other two. Here is the weird part and was wondering if she has any reason to go after the attorney's. The attorney who was or is representing her she found out was actually disbarred since February 2011 and she never was told this information. Supposedly she claims she was suspended and another attorney from another firm was assisting her with the cases she was handling since that time. Now this attorney signed off on documents that the disbarred attorney gave him regarding her case. Now to me this does not sound right. How can an attorney who has been disbarred practice law legally? And how does an attorney sign off on documents from a disbarred attorney? Isn't there some sort of illegal practice going on here. The second attorney is trying to close this case without a fee which is mysterious in itself like he is trying to get this case behind him because he knows he screwed up? Plus the amount they agreed to for my girlfriend was much lower than the amount her sister and the ex-wife received. I know attorneys stick together, but she has no idea who to talk to trying to find out if she is getting illegally represented, and what she can do from this point? Thanks for any suggestions.
