ways around statute of limitations

I was injured on the property of Tucson Medical Center seven years ago. I hit my head full force getting up from a cement bench outside hospice and hitting the top of my head on a huge tree that was directly above me. I immediately felt severe pain in my neck.

All they did was give me an x-ray and sent me on my way saying I was okay. When we got back home to Utah we received a bill from them in the neighborhood of $600. After some deliberating about that, they finally decided to drop the bill. After that, my neck starting getting worse and worse, I have had test after test, physical therapy,steroid injections and have to take very strong pain pills and muscle relaxers to have any relief from the severe pain I suffer, which doctors have told me is non-operable and degenerative to the point of total disability. This has all been a slow progressive thing, and when thinking of suing, I found Az. has a 2 year statute of limitations. I am wondering if there is any way around this, so that I may receive some kind of compensation for this injury that has disabled me and stopped me completely from my work (I was a nurse), and my previous active lifestyle.

Sorry you did not consult with an attorney within the two years. Seven years is a long time. Your message does not state if you were an employee or just on the grounds at the center. Also, you do not state what the negligence of the property owner was that caused the injury. Was this not an open and obvious feature you hit your head on? I wonder if the Medical Center was negligent at all. Did you hurt yourself on a fixture of the property that had some latent, difficult to see condition? Or did you presume that since you hurt yourself on their land, they were automatically liable? That would not be the case.

In short, you might not feel too badly about missing the statute of limitations, to which there is no getting around it appears, since you might not have had a case to begin with. Sorry for your injury. Hopefully you will find some medical relief. Good luck.
