Legal Question in Product Liability in Arizona
My wife and I ordered a custom aquarium through a local AZ company who then contracted with an aquarium manufacturer to build it. When it was delivered it had several problems. The manufacturer of the aquarium claimed bankruptcy shortly thereafter. The company we paid for this product claims they have no responsibility because "the warranty is a manufacturers warranty." Do I have recourse against the company we ordered the aquarium from?

It would be necessary to view your contract with both companies. Generally speaking everyone in the chain of the sale has responsibility under the terms of the sale. When you purchase custom goods, provisions of the uniform commercial code, which are recognized as laws in Arizona, specify your rights and the merchant's obligations under the terms of the contract. If you would like us to review your contract and help you determine an appropriate course of action to resolve this problem, don't hesitate to contact Stephanie Coulter of this office at 602 462 1004.
