Legal Question in Real Estate Law in Arizona
1st and 2nd mortgage forclosure
I am recently divorced and moved out of my house and my exhusband took over the payments. He has since quit his job and decided that he is no longer going to make the paymnets and let the house go to foreclosure. I am sad but have to be OK with it because in the divorce the house became his and I have no loegal claim to it. I am just wondering if the bank forcloses on my house what happens with the second mortgage? Can they sue me for payment?

Re: 1st and 2nd mortgage forclosure
The second is wiped out and cannot sue you personally, but the foreclosure will be against you on your credit report. See a consumer attorney or consult with your family law attorney on your divorce to be fully advised.
