We received an offer on our house on the last day it was listed. Of course, the buyers low balled us and we rejected the first offer. Finally, our agent came up with the idea that he would forgo his 3% commission and take a flat fee so that we could get the house sold. He did this on the agreement that we would use him to buy our next house. He also suggested that we let the listing expire so we did. We ended up writing an unrepresented sellers agreement and sold our house. In turn, we signed an exclusive buyer/broker agreement for 8 months. The market tanked and we backed out of the house we were going to buy. After four months, our agent left the brokerage that we had a buyer/broker agreement with. He never contacted us or told us about this and I only found out about it when the brokerage tried to set me up with a new agent. Well they released us from the buyer/broker agreement and we were never shown any other properties. A year goes by, still no contact with our former agent and the original buyer/broker agreement if it was in effect would have long expired by at least 6 months, and we find a different house. We buy the house w/o using an agent and now this agent contacts me wanting his commission. Does he have a claim?
