Legal Question in Real Estate Law in Arizona
Get back at my apartment
My apartment complex ended up taking me to court for not paying for our carpet to be replaced. The issue is that we requested a walk through, which they didn't give us, and when we asked the maintenance guy afterwards, he said it would be cleaned. They said it was beyond repair because it was in a major walkway. The stain was actually right next to a corner underneath the countertop.
I feel this apartment completely harasses us. After we agreed to pay the damages at the court, without paying any attorney fees or court fees and the case was dismissed. They wouldn't take a check from us, they tried to have my car towed because they said it was inoperable (I drove it everyday and it had current tags and insurance) because it looked bad. Our washing machine still doesn't work after 6 weeks of asking them to replace it.
What I want to know, is there anyway I can take them to court over anything? I found out they pretty much do this to all their residents and I think they should get what they deserve.

Sorry you are having problems with your landlord.
This is really a landlord-tenant question, not a real estate question. You might want to post it up in the proper section, and you will get an answer from landlord-tenant attorneys. Unfortunately, most landlord-tenant attorneys are hired by the landlords, because they pay to hire attorneys.
You cannot sue for an issue that was already the subject of a lawsuit that was settled, nor for an event that was transactionally related to that event. You cannot re-open a case that already went to court. Other issues you can. Perhaps you might look for a better landlord as well.
Good luck.
