Legal Question in Real Estate Law in Arizona

Bought a Business With Problems

I recently bought a restaurant business from a person who during the contract period told me numerous lies about the condition of the equipment and I have documented proof that they withheld the facts from me about major problems that are occurring with me now and They knew this was going to happen but told me that they never had any problems. The Hot Water heater catches on fire and the previous owner had it happen to him 3 times but told me that it was fine and they never had any problems with it. If I would have known this, I wouldn't have bought the place. What can I do about this?

Re: Bought a Business With Problems

You can always sue if you can prove your allegations. Perhaps your written contract speaks to this? Or does it say that no representations are made except those in writing in the contract?

See a business litigation attorney. It will cost you some money to go to court. Perhaps the cost of the water heater is not worth it, I don't know. What is the cost or repair? You don't state enough facts, and really need an in-depth consultation to evaluate this problem.

This is not a Real Estate and Real Property question. You might want to submit it under the Business Law category. You might get other opinions.

Good luck and best regards.
