Legal Question in Real Estate Law in Arizona
I was contacted by Resorts Condos Management regarding my timeshare in August 09. I was told they had a buyer for my condo for 19,750. I was sent a sale/rental agreement and authorization form to accept the deal. I also had to pay 2195.00 for title and closing costs. I was told that the prcess would take 60-90 days to complete and a check to be issued. Since October 10 I have been in constant phone delings with this company regarding the sale and hve been told everything from swine flue death to refinacing to IRS leans to keep me a bay. Today I was told that the money I sent and the contract I signed was for marketing and attempting to sell my condo. I expressed my displeasureand asked if it was normal business to lie to people about the sale and keep there money. I was informed that the 2195.00 was non-refundable and i states so in the agreement. I uderstood I was signing an agreement for sale not marketing. I'm I just out of luck on the 2195.00 because of the fine print in the contract?

I could not answer your question without seeing the agreement and reviewing the facts with you. It sounds like you have been caught in a scam. You may have an action against them, but what claims that you may have depend upon the facts and what they told you initially, and what they told you each time you called. You might have a fraud claim or breach of contract or something else.
