Legal Question in Real Estate Law in Arizona

court orders

What happens if someone continues

to ignore court orders? my ex

boyfriend and I separated and have

real estate in both our names. We

had an argument as to ownership

percentage versus income. I filed a

civil suit against him, and during the

process a judge ordered the house

on the market. A realtor could not be

decided on so one was court

appointed. After pre trial hearings

and mediation, we signed

agreements to split the equity 50

percent after our debt was paid out

of the equity. he then refused to sign

the sales agreement from the realtor

stating that he would not sign to sell

until proper repairs were made--his

attempt at stalling. He also said he

will not agree to that sales price and

that he will continue to live in the

house until the correct amount of

equity can be obtained. What can i

do? what are my rights? I want this

to be over with since I am still paying

for half of the mortgage, but not

living there. What can I do now? file

that he is in contempt of court? How

long does this process take? can he

be evicted so that he cannot

interfere with this process?

Re: court orders

If the judge did not already give the appointed real estate commissioner authority to sign if the opposing party refuses to sign, then you should request in writing that the court order the opposing party to cooperate or give the real estate commissioner the authority to go forward without the opposing party's cooperation.
