Failure to disclose

I recently purchased a ''new'' home (the home was advertised and represented as new) only to find out that it was recored and permitted as a rebuild/remodel with the septic tank dating back to 1960. The realtor/owner/builder (the same person) failed to disclose this information claiming that it was new. What recourse do we have?

It is not possible to explore all the facts and give a complete analysis in this forum for your problem. You likely may have recourse in a claim, lawsuit, etc. Is the home worth more or less than what you paid? That might be a consideration. Do you want out of the home, or just damages? I would also need to view the listing and representations made by the builder. Is the builder solvent? Judgment proof? Was the seller an individual or company? There are many questions to answer.
