foreclosure and 2nd mortgage

We fell behind in our mortgage and used a ''mortgage rescue loan'' to help. We than fell behind due to disability being decided. The second mortgage paid a few payments so that the bank would not foreclose. The second mortgage than foreclosed and offered out house at auction, no one bought it so he ''bought it back'', for twice the second loan but no where near the price of the house. He than evicted us. I still get mortgage bills from the bank, but they are being paid,(not by me.) It appears that my name is still on the loan and he is using it to pay off the first mortgage. The bank does not know that we have been evicted, and that we are no longer at that address. Is this Legal? Thank you.
