who gets house

My husband of 25 years had a house prior to our marriage. My name was never put on it. We are still married but he no longer lives here. If he should die before me will I get the house which I still live in and maintain? We have one child still at home.

The answer depends upon whether your husband has a will, and whether he has any children by a prior marriage. Don't take a chance. Get the proper legal papers. And a beneficiary deed is even more important, since it allows the property to pass to you without probate. Or, put the property in joint tenancy with right of survivorship.
