You will want to file for a Partition of Property.

The answer depends upon what your agreement was upon acquisition of the property and how you are holding title, which will determine your rights and obligations. In any case, you will want to sue the other owner to force a sale of the property, however, if there is no equity left in the property after a sale, you might want to consider just making an agreement to avoid any future liability arising out of the house and the mortgage thereon. You should retain experienced counsel to determine what the facts are and what your alternatives might be.
