House sale
In March of 2000 we sold our home in Az. and moved to florida.About 5 months after closing the buyer advises us that he had plumbing repairs of 2200.00 dollars and wanted us to pay that expense. They have filed with small claims court in az. and sent us certified mail, which we left ''unclaimed'' with the post office. Do we have an obligation to pay this repair bill or do we have the expense of flying to az. and attending small claims court. Thank you for your reply....

If you are properly served (you may be served even if you don't accept the papers) and do not respond, the Court can enter a judgment against you which can be collected in Florida. If you realtor did a walk-through waiver or a disclosure form you may be covered. Generally, it will depend on the words in your contract to sell, other forms done in conjunction with the sale, what type of problem the plumbing problem was, whether you made any representations regarding the condition which had to ber repared and whether the work done was necessary and reasonable.
