Legal Question in Real Estate Law in Arizona
My husband and our family live in his family home that he's lived in since he was a child. His father passed away 2 years ago, but prior to that he said he was going to go through the process to sign the property over to us. After he died we found out that the property is actually in my husband's grandfather's name, who passed away 20 years ago. We have paid the property tax on it for as long as I can remember. How do we go about getting the property into our name?

I have handled similar cases. The process takes some time and requires opening a couple of probate actions. However, if all that is involved is the property, you can likely take advantage of a streamlined probate process that will ultimately allow you and your family to take legal title to the property in a fairly short time frame. Keep paying the property taxes as well as any mortgage or other obligation on the property. Otherwise, you could lose it in foreclosure in the meantime.
