Legal Question in Real Estate Law in Arizona

including property in my trust

I bought a time share in Hawaii. I have a trust already set up in my name. I want to include this time share with the rest of my trust but my trust consultant says that he can't make the transaction because the property was bought in Hawaii. How can I protect this property for my childrens inheritance?

You need a lawyer in Hawaii to draft a deed to put the property in your trust. Hawaii has strange requirements for recording deeds, so it won't be cheap.

Re: including property in my trust

You can preclude your children from receiving the property either by

1) specifically listing it in your Will

2) place it in trust by filing a 'quit claim deed' in the county in which the property is located in Hawaii. FYI- Your trust 'consultant' should be able to do this or easily find an attorney who can.
