Lease Questions - Please Help
When me and my boyfriend moved into our apartment we both signed the lease, since then we've broken up and I moved out. I contacted our landlord about removing my name from the lease and she informed me that my ex would have to resign the lease, however he refuses to do so. He's even threatened to call the cops when I've come on the property in an attempt to contact him. Is there any legal action I can take to get him to resign the lease? And if my name is still on the lease am I legally allowed to be on the property?

Here is yet another illustration for all who read on Law Guru of the problems faced, usually by the women, when they move in with a "partner" without marriage, no written contract, and find that those sweet guys who had no commitment to marry them have no lasting commitment to be fair. We see people putting "boyfriend" on deeds to homes, and here, on a lease. These guys have not changed, they never made any lasting commitment in the first place.
If you are on the lease, you are jointly responsible until the end of the lease. You cannot force your ex boyfriend to resign anything. Technically, you have equal rights to live in the apartment, but it sounds like it would be unsafe for you. See what you can negotiate with the landlord. Give notice that you are vacating. Speak with a landlord/tenant attorney. You might want to re-submit your question in the landlord/tenant section of Law Guru. This is not a real estate question, it is a landlord/tenant one.
I do not want to appear insensitive to your situation by my answer. I know this is difficult for you. We see these type of situations constantly in this forum. I frankly doubt that women will stop moving in with temporary partners leaving themselves with no written agreements or protection, but perhaps a few will be educated or warned by what they read here.
