Legal Question in Real Estate Law in Arizona

second mortgage

After leaving my husband and

getting a separation agreement. Our

assets should be divided equally but

recently he took a second mortgage

for at least 45000 on the house in

both of our names without my

permission and without my signature

and pocketed the money and or

spent it. is this fraud and do I have

any legal recourse.

Any loan against the property you did not sign for should go against only his one-half of the house. It is unusual for a lender to make such a loan. I would immediately investigate this further. See a family law attorney. Your name may have been forged.
