Legal Question in Real Estate Law in Arizona

Neighbor's tree falls on our car durring storm.

This may be posted in the wrong area but any info would be appreciated.

Durring a recent storm, my neighbors tree fell on to my property and landed on my car.

My question is who is responsible for the damage? The tree is still there because it is way to heavy to lift. The neighbors are on vacation and I dont know when they are coming back. Should my ins. pay for the damage/ tree removal or should their ins. pay for it since the tree is on their property?

Thanks

Re: Neighbor's tree falls on our car durring storm.

You have a duty to minimize the damages and it is best to get your car into repair as quickly as possible. I suggest that you take many pictures and then fix the damage to your property using your insurance. Your company will then go against the neighbor for reimbursement of the costs paid to repair your property.
