Legal Question in Real Estate Law in Arizona

removable property

Sold ranch. Gave buyers list of equipment that would remain. One item on list was ''one'' cattle chute. Two on property, new one that was removed and old one that was left as was originally intended by listing single chute. Buyer called and threatened suit if new one was not returned. It had been held to concrete pad by two bolts to keep it from moving as cattle were worked. His claim is that this made it part of the ranch. Chute has been returned, but would like to get it back.

Re: removable property

It sounds like the buyers would have believed that the new chute was the one that was included with the property. I would not split hairs over this because you would probably lose. In the future, it would be better to replace anything you intend to keep before marketing the property or provide an express exclusion of the item in the listing information.
