I own a house that my father was staying in. He has moved out and is living with his new wife. He has been renting out the house to another person with out my permission or knowledge of him doing so. Now that I know am I entitled to the rent money he has been paid by the tendant? Its not his house to rent!!??

Re: renting

Have the tenant sign a lease with you if you want to keep the tenant, and have the tenant understand who gets the rent. If you don't want the tenant, evict him.

An attorney in Arizona who is expert in landlord tenant (that's what this issue is, not really real estate) will know how to get the tenant out, or can provide you with a state-of-the-art basic lease. Such a person would be Denny Dobbins in Mesa, Arizona or any member of his firm. They represent about 50,000 rental units for landlords. Phone 480.962.5353.

Good luck.
