Legal Question in Real Estate Law in Arizona

Residential lease application

I recently contacted a Realtor in Arizona about a rental property she had listed. After flying out to tour the home, I signed a residential lease application by fax. Five days have gone by and she has not confirmed that it has been accepted by the landlord (required by contract) nor has she advised me where to send deposit. Per the contract, certified funds are to be received by the landlord by tomorrow. As I am in Oklahoma, my bank is Arizona, and he is in New York, this is virtually impossible.

On a sidebar, the realtor took it upon herself to contact a new home builder that I mentioned I went to see. She asked them to sign her in as my agent without my permission! When I called her on it, she got very snippy.

Is it possible that she is submarining our rental deal out of spite? Do I have any obligation to continue or can I find a new rental?

Re: Residential lease application

I assume that your Realtor used the standard Arizona Association of Realtors form titled "Residential Rental Agreement and Receipt for Deposit." If this is true, and you signed this particular form, then my advice is as follows:

If Landlord does not accept your offer to rent the Premises by the date and time listed on line 188, then your offer to rent is considered withdrawn and you have no further obligation to the landlord or the Realtor.

IF YOU SIGNED ANY OTHER DOCUMENT OTHER THAN THE ONE I REFERENCED ABOVE, THEN DISREGARD THIS RESPONSE.
