Legal Question in Real Estate Law in Arizona
shared well agreements
I purchased my land and have a shared well agreement with 4 other parties. A new owner of parcel 2.where the well is on a 30' x 10' utility easement...now says he owns the well, because it is on his land. the original agreement just says we all share in the expenses of maintenance and upkeep of the well .but thats all. He says he is still willing to share the water with us. Can he void my original agreement? he has also put up a fence that blocks my access from my easement to the well.....i can go around to the other road to get in.....but I just need to know my rights. Thank you

Re: shared well agreements
This looks incredibly like the same question posted a while ago. Is this the second time you have posted this on this site? If so, follow the advice previously given to consult with a water attorney, Scott Larmore in Phoenix. This is too complicated to get into responsibly on the limited facts you give, and will require an attorney anyway.
Thanks.
