Legal Question in Real Estate Law in Arizona
My sister and her boyfriend bought a house together, and her boyfriends dad cosigned for the loan. Now my sister and her boyfriend have broke up. She is curious if there is a way that she can get her name off of the mortgage because he doesn't want to sell.

Her boyfriend would have to refinance the mortgage in his name alone.

The easiest solution is for the boyfriend to refinance the mortgage in his name alone as suggested by Don Scher. If he refuses to refinance your sister can file a petition requesting that the court order that the property be sold. Either of these options may be difficult to achieve if the property is worth less than the current amount of the mortgage.
