What happens next after filing claim with EEOC
What happens next after filing a claim with EEOC and the employeers lawyer refuses arbitration? What kind of damages can be recovered if I was constructively terminated due to the continuing hostile work environment?

Re: What happens next after filing claim with EEOC
The answers to your question depend entirely on the circumstance and facts of your situation, which you have not shared. The best way to get a grip on the law concerning your case, and whether your employer's treatment was illegal, is to talk to the EEOC directly. The EEOC will review your claim and determine whether it meets their criteria to bring a claim. If the EEOC determines that you have a viable claim, they will discuss the particulars of the claim with you, and you and they will decide whether to go forward with the claim. If so, the EEOC has a legal process it follows, which will be explained to you.
The EEOC may also ask both you and the employer to submit the claim to mediation, as the first attempt to settle the claim without litigation. Your best source of information, in otherwords, is the EEOC staff, although you also have a choice of pursuing the claim independently, in a civil proceding. I am an attorney/mediator, and am called in to mediate employment disputes. However, at this point in time, it sounds like you need to talk to the EEOC first, and possibly consult a lawyer to discuss your legal rights in your particular situation. If you want a referral to an employment lawyer, please feel free to contact me - I do know some good lawyers in that field to whom I could refer you. Good luck.
