Legal Question in Sexual Harassment in Arizona

My physician has been telling me I am look really good, has called me sexy, and a foxy woman. He has given me kisses first on cheek and then on lips, which I initiated the lips kiss. He gave me an injection in knee and during painful moment I said how deep are you going to stick that thing. He waited about two minutes and said that's what my girlfriend said to me. I said what? He said how deep are you going to stick that thing. He asked me what I was going to school for. I told him, and said I wanted to get a job with a company that does its research overseas. He said take me with you, I said well I haven't gotten the job yet. He said I'm serious take me with you, I am an excellent traveling companion. My daughter came with to an appointment, he walked in and said hello. He then said, by the way you look beautiful today. I just smiled. I approached him with my concern about inappropriate flattering remarks he made in office. And said he was bold and I can't do that in the office. I told him I liked his remarks and felt the same way toward him, as far as attractiveness. I asked him if he would care to have coffee or a drink with me. He said he was on call and if I gave him my phone number he would call me on Monday. He said we are both adults and we could do this, and we would have fun together. He kissed me on lips in parking lot. He didn't call me and he is my workers compensation physician. He has just recently performed a surgery on my knee. I am now leery about his intentions and want to document what transpired. He may say I approached him after work, which I did, but only to elaborate upon his remarks and intentions toward me. He is very bold. He has looked at me in a way that made me feel as if I was being undressed with his eyes. For lack of a better description. I do not want any problems as far as me being accused of inappropriate advances. This has been going on since the early part of December 2008.

Your physician has most definitely made inappropriate statements and made inappropriate gestures. This violates the doctor-patient relationship and he could lose his license to practice medicine as well as a great deal of money in a judgment if you sue him. It most certainly is sexual harassment. However, it does not help your case that you initiated and/or responded to some of his advances. Still that probably will be outweighed by the fact that a doctor is in a position of authority over a patient, who is in a more vulnerable role in the relationship.

Absolutely complain to the state medical board that licenses him and if need be take him to court!
