Legal Question in Tax Law in Arizona

decade old back taxes

I received a bill today for 1997 taxes.Can the IRS collect on this I thought after 10 years it was too late.I was a resident of California until May 2007.I now reside in Arizona.Please define this tax law.

The 10 year statute of limitations is based upon three items. 1. When was the tax return filed. 2. When was an additional assessment made. 3. If no tax return ever filed, then there is an arguable unlimited statute of limitations.

The caveat on this is that if you were convicted of Fraud as to a certain tax year, the statute of limitations is additionally unlimited.

These are some of the issues that I or another Tax Attorney would need to look at to make an assessment.

The Statute of Limitations on the IRS collecting taxes is 10 years from the due date or the date of filing, whichever is later. I presume that your question concerns 1040 taxes. If you filed your 1040 for 1997 timely,that is April 15, 1998, the IRS normally would only have until April 15, 2008 to collect. Nevertheless, this period may be increased by a Bankruptcy, Offer in Compromise request or an Extension of Time.

You need a good tax lawyer to help you with this issue.
