82 Years Old and No Will

My Wife's mom is 82 years old, her husdand died 1993, and she will not have a will drawn up. She has about $350,000 in property value. If she dies without a will, can my wife still obtain her assetts or will the State of Arizona get it?

The State only takes the assets if no family members can be found.

In your case, since Mom is unmarried, her assets will be split equally between her children. If any of Mom's children have already died, then that child's share will go to deceased child's children.

Her children will inherit through the intestacy laws, but there will be a probate case to settle the estate.
