Legal Question in Wills and Trusts in Arizona

i am afraid with the way times are changing these days and days to come that my 11 year old daughter wont be able to spend her settlement money she received after being bit in the face by a pittbull. she has a resticted acct and i am her mother and conservator. i am aware of my duties but i feel bad because i am sure that by the time she is 18 times will be even worse. there are everyday things that arise that she needs and i am not able to provide for her, since losing my job. i know these accts are for the protection of the minors money, but are there exceptions and what steps should i take. our case settled around 12/2010. thank you very much

In order to spend any of the conservatorship money, you must first go to probate division of the superior court and ask for an order approving such expenditures. If the money is determined to be needed for her education or health, and not for something that the parents are ordinarily expected to pay, then you may have the chance to use some of these funds before she reaches the age of 18. This is not usually money that could be spent on a vacation for her, the court would be looking for a use that is necessary for her education or health, and that the only source available to pay for such a need is the conservatorship funds.
