Legal Question in Wills and Trusts in Arizona

Claiming Property of a Deceased Family Member with no Will, etc.

My grandfather & mother were murdered in March, 1999. Neither left a Will,

Trust, etc...My problem is, the local post office tells me I can not retrieve

my grandfather's mail from his rented PO box. They also stated that I can not

make any payments on it to keep it active, because he is deceased. I am the

Sole survivor of this family. There are no other living relatives. I presented

the Postmaster an Original Death Certificate, at which time, he stated, I now

need a "Power Of Attorney". How can I possibly get a POW when my grandfather is deceased? Is this the correct info I was told? I am only 18yrs

old, and I am declared "learning Disabled". Please help me, I would appreciate

any and all advice.

ThankYou,

Re: Claiming Property of a Deceased Family Member with no Will, etc.

I am very sorry to hear of your tragedy. If your mother or grandfather had any assets in their name only then their respective estate must pass through probate. You need to begin this process as soon as possible. With reference to the mail, contact the post office and speak with the supervisor. Explain to the supervisor your situation and ask if they could hold all the mail until you have the proper documents from probate court to collect the mail. Retain an attorney whereby this attorney could handle this case low cost if their isn't any money in either estate or if there is money in the estate(s) then ask if the attorney could get paid from the estate. What you need is the document stating that you are the only survivor and thus be named the personal representative and only beneficiary of the estate. If you have further questions, please feel free to contact me. Sincerely, Melody Stickel-Martinez, Esq. (954) 437-5968.
