Legal Question in Wills and Trusts in Arizona

distributing inheritance to veteran under controlled finances

If a beneficiary is on Veteran's disability, but his money is managed/controlled by a third party, is he elgible to get an inhertiance distributrion from a trust? Or must the 3rd party be involved in the distribution or, can the trustee maintain control of the money and pay him in payments, though no provision exists for that?

Re: distributing inheritance to veteran under controlled finances

The Trustee of a trust is obligated to carry out the terms of the trust provisions that determine how the money from the trust is to be distributed to the beneficiary. Just because the beneficiary is a disabled veteran, does not mean that he cannot receive benefits from a trust payable to him. Benefits from the trust are technically not an inheritance, since the trust is a separate legal person and the benefits paid are not as result of a probate proceeding. It is important to look at the provisions of the trust agreement.
