Legal Question in Wills and Trusts in Arizona

Estate Law

I received a letter from my dad's attorney saying that "we are unable to make the distributions to you at this time. However, we are making progress and expect to provide the inventory and these specific distributions to you within the next 60 days."

That was in September 2009. The 60 days has long since passed. I've received nothing from the attorney or the distribution owed me.

Shouldnt the attorney of sent me another letter in November to let me know that he was still unable to do what was promised within that time frame. That complications had arose that were slowing the process. That more time was needed and/or that I would be contacted when everything was finally inventoried? Or at least called me to tell me this?

Thank you for your time.

Sincerely,

BLE

This sounds more like a communication issue than a legal question, but is appropriate to ask. The simple suggestion is that you either write a note to the attorney to find out the status or call the office. There could be many reasons why the distribution did not take place yet. In the sentence you quoted, the attorney is merely stating that an "expectation" which you took as a definitive date.

While your expectations are understandable, your frustration may be a bit premature. There is nothing inappropriate about your asking about the status, but keep in mind that the attorney represents the estate and not you individually.

You are entitled to information regarding the status of the estate. By law the personal representative must provide an inventory to persons entitled to notice within 90 days after he/she is appointed. If more than 90 days have passed, you should take the initiative and inquire. If you have further questions you may contact me by email through my website at www.meyerlawaz.com.
