Legal Question in Wills and Trusts in Arizona

estate question

My grandfather died in 1977. The property my parents live on now is still in my deceased grandfathers name. How can we get that changed to my parents' name? So when they pass away this will not be a problem : settling their debts by selling the property. Or putting the property in another relative's name.

Re: estate question

Depending upon the value and whether there is a mortgage, you will likely have to go through a probate case. There is no other way to get title. Did your grandfather have a will? Who has it? Who is named as personal representative (executor) in the will? Or did he die intestate (no will)? Did he have other children or heirs other than your parents? Was the house in joint tenancy with your parents?

We offer free, no obligation consultations by phone or in person to answer these questions and advise you. We do probates in all Arizona counties for the same cost as a Maricopa County probate (no additinal travel costs). You can arrange a free consultation at 480.835.1500.
