Legal Question in Wills and Trusts in Arizona
No executor named for my deceased sister's estate.
My sister passed away on 3-25-2009 and did not have anybody named for her small estate. Her debt includes an motorcycle loan with $7,500.00 remaining on the loan. Are we, the immediate family responsible for that debt? I am her brother and I am the beneficiary on her IRA account. Can the creditors come after me and try to get monies from the IRA? Thanks.

Re: No executor named for my deceased sister's estate.
If your sister had no Will and the estate is worth less than $75,000, you can file an affidavit with the court to obtain her property legally. The IRA is yours and nobody has any claim against that. The cycle lender can repo the bike, but cannot go after you for payment of the loan.
