Legal Question in Wills and Trusts in Arizona
Executor named in will is refusing to open probate distribute funds, is spending money and has left country. Can I file to open probate with a copy of will since I am decedent's son?

Yes, you can. You should take action immediately and retain an attorney who can help you stop the named executor from taking the estate for himself. You may also consider filing a criminal complaint if he/she has taken the estate money and fled the country.
