Legal Question in Wills and Trusts in Arizona

house payments

My mother passed away in August, the house is in her name. As is it part of the estate and payments are due and cannot be made, what do I do in today's market in Glendale Arizona so the house isn't lost?

You should open a probate and gain appointment as personal representative of the estate. As personal representative (formerly known as the executor), you can make the payments due and maintain the property until distribution of the property to the heirs occurs. Be aware of the other payments in addition to the mortgage, such as insurance, taxes etc.

You should consult with an estate attorney immediately. It might be possible to avoid probate. Did your mother have a will or trust? Who are the beneficiaries of her estate? How much is the house worth? How much is the balance on any mortgage?
