First, you carefully draft it so that the language exactly provides for all the terms, operation and planning you want, making all the decisions as to the various issues of the trust. (This is something general practice attorneys are reluctant to do, even if they have a sample "form" since in estate planning one size does not fit all.) Make sure the language is unambiguous, so that it will not be contested or open or argument. Decide among the fifty different ways to structure the trust for the beneficiaries, trustee, trustor, whether it will be lifetime or not for beneficiaries, protect beneficiaries from creditors or not, what kind of trustee, removal clause or not, group trust or individual, credit shelter for inheritance tax protection, or not if you do not need that, etc., etc.

Then you properly execute the trust.

Then you fund the trust by transferring appropriate assets to the trust by the proper conveyance documents (deeds, assignments, bills of sale, etc.)
