Re: Obtaining copy of the trust

Trusts are private agreements and must be disclosed to qualified beneficiaries under circumstances controlled by the new AZ Trust Code provisions. In order to force disclosure, you would have to go to the probate division of the Superior Court to petition the court to force the disclosure.

If the trust is to be created under a Will, then there is no jurisdiction by the court, because a person can revoke a Will anytime or make a new one and change the provisions. Again, a Will is private and not required to be disclosed until the maker dies and the Will is presented for probate.
