Legal Question in Wills and Trusts in Arizona

Personal Representative of my late father's estate

My younger brother is petitioning to have me removed as executor of my late dad's estate. He wants to close the estate but, my mother still lives there on a fixed income. Doesn't he have to prove he is better suited to replace me. He has an 8th grade education and has lived off my mother's support his entire life. He is now 49. What type lawyer do I need to talk to?

No professional opinion can be given in this case without all the facts, an examination of the will and all the documents filed with the court, as well as a copy of the petition filed by your brother. Does he have an attorney? Do you have an attorney on the probate?

We offer free initial consultations with no obligation in estate and probate cases. What county is this in? There are many questions to answer before you can know where you stand.

Did your mother receive the statutory allowances as surviving widow?

480.835.1500 to arrange a consultation by phone, but would have to see all the papers as indicated above. The estate pays for the attorneys fees if there are any.
