Power of Attorney/Probate

My father had a stroke approximately two years ago and is moderately incapacitated. How do I represent his interests in a hostile probate situation with my mother. Needless to say, I am siding with my father in this matter.

More facts would need to be known about this situation. If your father is able to execute powers of attorney, or a trust, you could handle things in that manner. This will all depend upon the degree of incapacity.

The most effective way to protect your father would be to hire a lawyer to obtain a guardianship. Good Luck.
