Legal Question in Wills and Trusts in Arizona

revocable trust funds

my father died april 1, 2006. my stepmother has not put any of my fathers bank accounts, stocks, and car, outside the trust fund in probate. My question is: Is it too late to do anything? Her original lawyer told her this was not legal. She changed lawyers.

You need to hire your own lawyer and open the probate yourself. Do not delay.

More information is needed to advise you fully in this matter, therefore this message will be general and not specific advise in your case.

I advise you to consult with an estate attorney at once. You are always welcome to consult with me.

I do not know what the trust or will provide, who is entitled to what, whether you have any beneficial interest in the estate or trust, etc. Get a copy of the trust and will if you do not have one. If the custodian of the trust document (with any amendments) and will will not turn over copies to you, see an attorney. It is required by law that they comply.

After a full consultation, with a review of the will and trust and all pertinent facts, your questions and rights can be addressed.

Best regards,

James D. Jenkins

P.S. A tardy probate can be opened after two years, so it is not necessarily too late at all. See an estate attorney.
