Legal Question in Wills and Trusts in Arizona

My sister gave me power of attorney to handle her affairs, and died of her cancer without writing a will. She has retirement and 401K worth about 55K. Will I have to do probate?

Yes, a probate is required if her estate is more than $50,000, however, it is not a difficult thing to do and does not take long. Your power of attorney ceases to be of any effect the moment your sister passed away. You will be reimbursed from the estate for the costs, expenses and fees involved in the probate process.
