Legal Question in Wills and Trusts in Arizona

Trust Question

Mom passed away in January 2009. I was appointed Successor Trustee. After all assets and such were sold, distributed inheritance to 5 of 6 siblings. 6th sibling does not want money now due to her getting grants, child support and wants money left in trust. I need to know if she can do this as she is a career student (45) and she wants me to setup a CD in the Trust name for her.

You must administer the trust according to its terms and not according to special requests by a particular beneficiary. The trust agreement probably provides that it should be wound up and terminated upon distribution of the trust estate.

Secondly, you do not want to be involved in anyway with any action, false statements or other conduct which could be interpreted as a fraud on her creditors or others.
