Legal Question in Wills and Trusts in Arizona

Will Change

My father passed away leaving everything to my stepmother in his will (according to her). My sister and I still haven't gotten to see the will. She has 2 children from a previous marriage and my father has 2 children from a previous marriage. She told us that the will was set up that when both of them died, everything would be split amongst the 4 children. Since my father has passed, can she now change the will and take both my sister and I out?

The answer is, unless he created a trust that protects your interest, probably yes. I would check with the court to view the will, if one exists. If she has filed nothing, you can open probate, and if no will exists, you can request an heirship proceeding to protect your interests. You need an attorney.
