Do I need a will?
My husband and I are going on vacation without our two small children and need to know how to go about writing out a will (giving information about where we want our children to live if we were to die). Can we simply do this ourselves, do we need it noterized, or do we need a legal document? How specific should it be?

Your questions are a clear indication that you could benefit mightily from professional help. Why take a chance that you could miss something or make a mistake that could cost your children and other heirs a great deal.
Wills are relatively cheap in the law, and I recommend you see a lawyer about getting them done. Do you know what a living will is, for example? Should you have one?

You do need a will. Considering the fact that you have children and one of your concerns is their upbringing after your death I would suggest that you have an attorney prepare one for you. The cost for a Husband and Wife will is normally somewhere between $150.00 and $200.00. I normally do not recommend that non-lawyers try to write their own will but it is something that you can do. It will need to be witnesses and the signatures notarized. It should be specific enough to explain exactly what you want done and who is to be appointed guardian and conservator of your children in the event of your death.
