Legal Question in Wills and Trusts in Arizona

Which will

I have a mother that wants to have a will. She has married several times and is currently in the process of a divorce. She has three children from one husband and one from another (no children from any of her last three marriages). What type of will should she have to equally divide all of her limited assets (definately under $100,000). Had difficultly picking the will to purchase and download.

Thank you for your help in this matter.

Re: Which will

You must be careful, "do it yourself" with legal documents is fraught with difficulties and pitfalls, and you are taking a big risk that the Will won't be valid, if it is not prepared and executed in a legal manner. Forms are written by many people in many states and most forms cannot be "filled in" without having some expertise. Wills are drafted by lawyers for very small fees and are worth it, to have it done correctly. There is more to a Will than who gets the assets.

Re: Which will

A complete yet basic estate plan should include a Will ("self proved" is the only way to go, requiring two witnesses and a notary and the proper wording), Personal Medical Directive, Financial Durable Power of Attorney, Health Care Power of Attorney and if there is a home a Beneficiary Deed to avoid probate.

In your mother's situation, with the facts you describe, do-it-yourself dentistry would be as well-advised as do-it-yourself estate planning.
