Legal Question in Wills and Trusts in Arizona

wills

My father recently passed away, his only will is 38 years old , at the time he was married. 1st he bequeths everything to his wife, 2nd to his 2 childeren. However since then he was legally divorced [aprox. 33 years ago]. My Question is, does my mother have a claim against my fathers Estate, if we file this will?

Re: wills

It is never possible to pass judgment on a will not seen in person. I would need to see the will. My feeling is that the divorce will terminate his ex-wife's claim, but again, I need to see the will and have more facts to give an opinion. Also, with no information on the assets and size of the estate, there are other matters that need to be addressed.

You can get a free, no obligation consultation to address these matters by calling 480.835.1500, but you would need to bring the original will with you and have other information on the assets and size of the estate.

Best regards.
