Legal Question in Wills and Trusts in Arizona

Wills & Probate

How is a sibling notified that they have been selected as the Executor of a parent's estate? Once a sibling is selected, does that imply that the selection comes from the parent's Will and how do the other siblings view the Will and verify that a fair distribution of the parent's assets occurs?

Re: Wills & Probate

An executor may be nominated in the decedent's Will or any qualified person can file a petition for appointment as executor/Personal Representative (the new term). It is then up to the court to decide who should be appointed PR. When a petition for probate of a Will and appointment of PR is filed, copies of the Will are sent to all interested parties and they are given notice of the proceedings. Distribution of the assets is done under court supervision, so that anyone who has a complaint can bring it to the attention of the court and ask for orders.
