Legal Question in Wills and Trusts in Arizona

wills and trusts

My father died in April, and I still haven't heard anything about a will. My stepmother mentioned that my stepsisters are trying to get money from a new trust that I also know nothing about. she has already sold almost everything in their house, and is selling the house too. She has not probated the will yet. I am my father's only living relative. Should I be worried? What should I do?

Re: wills and trusts

It is not clear where your father resided at the time of his death and where the real property is located. Whether in AZ or California, you should obtain legal counsel and take whtatever action is necessary in order to determine what the facts are, what the trust agreement provides, was the house titled in the name of the trust and are there any assets in your father's name, and a number of other questions.

Your stepmother may be exploiting the situation, however, it may not be the case. Many times, the father leaves everything to the second wife and seems to forget the interest of the children of his first marriage.

Take action as soon as possible.
