Legal Question in Wills and Trusts in Arizona
wills and verbal bequest
My father recently died and now his girlfriend (they were not cohabitating) is claiming he said he'd ''take care of her'' and she wants $60,000. There is nothing in writing and he never said anything to me, his PR. He left a written list of items she was to receive and she has gotten those items. He was ill with cancer-brain and lung-and did have an altered status at times. Does she have any type of a claim?

Re: wills and verbal bequest
A promise to make a gift is not enforceable. She has no claim.
Re: wills and verbal bequest
She likely has no claim, but without all the facts no proper opinion can be given. See an attorney for guidance in handling the estate. We offer free, no obligation consultations, which can be by telephone, at 480.835.1500. Best regards.

I agree with Donald Scher. The girlfriend has no claim.
Re: wills and verbal bequest
Well, not really, unless she has some proof of that agreement. The only two people present were her and your father, and your father is now deceased so cannot be consulted. Unless there was a recording or writing or something else memorializing a contract to that effect, she has no valid claim.
